MANILA, Philippines — Hanggang sa huling State of the Nation Address (SONA) ni Pangulong Rodrigo Duterte, ayaw pa ring itodo ng presidente ang paggigiit sa tagumpay ng Pilipinas kontra Tsina sa 2016 arbitral ruling ng West Philippine Sea — wala pa rin daw kasing kalaban-laban ang mga Pinoy kung mauwi ito sa gera.

Ito'y kahit ika-12 ng Hunyo lang nang sabihin ni US Secretary of State Anthony Blinken na magiging epektibo ang Mutual Defense Treaty ng Amerika at Pilipinas "kung aatakihin ang Philippine armed forces, public vessels o mga eroplano sa South China Sea."

"How can we fight China? Do we have the weapons? ... Now comes America. They said that [in the event that there is an] attack is against the Philippines, they will defend. But they issued a statement that America does not meddle in conflicts involving the boundaries of other nations," ani Digong sa kanyang talumpati kanina.

"And if America has to go to war, they would have to go to American Congress to get authority to go to war."

Sinasabi itong uli ni Duterte kahit pumapalag naman ang maliliit na bansa gaya ng Vietnam laban sa Tsina, pero hindi nagkakaroon ng digmaan.

Una nang sinabi ni Jay Batongbacal, direktor ng UP Institute for Maritime Affairs and the Law of the Sea, na maraming pwedeng gawin ang Pilipinas para tumindig nang hindi ito nauuwi sa tuwirang gera.

 

 

Hunyo lang nang iulat na umabot hanggang 238 na banyagang barko ang natagpuan sa loob ng exclusive economic zone ng 'Pinas sa West Philippine Sea. Ayon sa US-based Simularity, malamang ay Tsino ang mga ito.

Kilalang malapit na kaibigan ni Duterte si Chinese President Xi Jingping sa gitna ng agawan at harangan sa dagat, dahilan para sabihin ng ilang kritiko na malambot ang paghawak niya sa isyu.

Amerika, dedepensa ba o hindi?

Tama si Duterte nang sabihin niyang dapat munang dumaan sa US Congress tuwing magdedeklara ng gera ang Estados Unidos.

Ito ang sinasabi sa ilalim ng Article 1, Section 8, Clause 11 ng kanilang Saligang Batas:

"[The American Congress has the power to] declare War, grant Letters of Marque and Reprisal, and make Rules concerning Captures on Land and Water."

Gayunpaman, walang binabanggit sa Mutual Defense Treaty na kinakailangang magdeklara ng gera ng Estados Unidos oras na kailanganin ng tulong pandepensa ng Pilipinas sa gitna ng isang atake.

"Each Party recognizes that an armed attack in the Pacific area on either of the Parties would be dangerous to its own peace and safety and declares that it would act to meet the common dangers in accordance with its constitutional processes. Any such armed attack and all measures taken as a result thereof shall be immediately reported to the Security Council of the United Nations. Such measures shall be terminated when the Security Council has taken the measures necessary to restore and maintain international peace and security."

Tumutukoy ang "armed attacks" sa mga pagsalakay sa metropolitan territories ng magkabilang partido, o sa mga island territories na nasa ilalim ng kanilang jurisdiction sa Pacific Ocean, kanilang armed forces, public vessels o aircraft sa Pacific.
