MANILA, Philippines — The Department of Labor and Employment on Sunday reminded employers of the proper payment of wages for workers who will report to work on the upcoming holidays.

In an interview with Radyo 630, DOLE Secretary Bienvenido Laguesma said that October 30, November 1 and 2 are special non-working holidays, which means the "no work, no pay" rule will be applied.

DOLE issued last week an advisory specifying the the wage computation for the upcoming special non-working holidays. Workers will receive compensation based on the following rules:

  • If the employee did not work, the “no work, no pay” principle shall apply, unless there is a favorable company policy, practice, or collective bargaining agreement granting payment on a special day.
  • For work done during the special day, he/she shall be paid an additional 30% of his/her basic wage on the first eight hours of work (basic wage x 130%).
  • For work done over eight hours (overtime work), the employee shall be paid an additional 30% of the hourly rate on the said day (hourly rate of the basic wage x 130% x 130% x number of hours worked).
  • If an employee works on a special day that also falls on a rest day, the employer shall pay an additional 50% of the basic wage on the first eight hours of work (basic wage x 150%).
  • For overtime work on a special day that also falls on the employee’s rest day, workers shall be paid an additional 30% of their hourly rate on the said day (hourly rate of the basic wage x 150% x 130% x number of hours worked).

Laguesma reminded the public that the “no work, no pay” policy may not be applied in workplaces with an alternative arrangement that still pays workers on special non-working holidays.

"There may be an existing company policy that, even if you don't come to work due to a holiday, you will still be compensated, or any similar kind of arrangement your employer has," Laguesma said in Filipino.

The 2023 Barangay and Sangguniang Kabataan Elections will fall on Oct. 30, 2023.

Meanwhile, November 1 is All Saints' Day, while November 2 is All Soul’s Day and classified as an additional special non-working day.
