MANILA, Philippines —  Paglabag sa Labor Code ang hindi pagdedeklara ni Pangulong Rodrigo Duterte ng bayad na "regular holiday" sa araw ng halalan sa ika-9 ng Mayo, bagay na kinastigo ni vice presidential candidate Walden Bello.

Huwebes kasi nang ianunsyo ng Malacañang na gagawing special non-working holiday ang Lunes, dahilan para maging "no work, no pay" ang mga manggagawa't empleyadong pipiliing bumoto.

"I condemn the Duterte government for trying to fool working people and depriving them of what is duly theirs by law: the right to cast a vote without losing a day’s wage," wika ni Bello, Biyernes, sa isang pahayag.

"By declaring Election Day a mere special non-working holiday, the government violates Art. 94 of the Labor Code, which clearly lists the day of the general election as among the regular holidays that entail full pay, or double pay in case of work (not just an additional 30%)."

Sa ilalim ng Article 94 (c) Labor Code o Presidential Decree 442, series of 1974, sinasabi ang sumusunod: 

As used in this Article, “holiday” includes: New Year’s Day, Maundy Thursday, Good Friday, the ninth of April, the first of May, the twelfth of June, last Sunday of August, first of November, the thirtieth of November, the twenty-fifth and the thirtieth of December, thirty-first of December, and the day designated by law for holding a general election.

Una nang ipinanawagan ng Anakpawis party-list kay Digong na ideklara ang isang regular holiday sa Lunes, lalo na't panghihinayangan pa raw ng mga manggagawa na bumoto dahil sa mawawalang sahod.

Aniya, magiging "disinfranchisement" ito sa hanay ng mga nagtratrabaho, na siyang kumakatawan sa 45.33 milyon katao sa Pilipinas. Malaking bulto na ito ng kabuuang 65.7 milyong registered voters sa loob ng bansa.

"With its declaration, Malacañang has once again shown that it is beholden to the interests of the capitalist class above anything else," patuloy pa ni Bello, na siyang running mate ng presidential candidate at labor leader na si Ka Leody de Guzman.

"The government should stop cheating workers and uphold workers’ right to vote. Declare Election Day a regular holiday with full pay now!"

Ang mga manggagawa't empleyadong pipiliin pa rin ang pagtratrabaho sa araw ng eleksyon ay hinihingi ng batas na bigyan ng dagdag 30% ng kanilang daily rate. Kung regular holiday ang araw ng eleksyon, bayad ang mga manggagawang boboto pumasok man sila o hindi sa trabaho.

Matatandaang idineklara rin ni Duterte bilang special non-working holiday ang ika-13 ng Mayo noong nakaraang 2019 midterm elections.
