MANILA, Philippines —  Filing of motions and other papers related to the declaration of nullity of marriage or its annulment must go through electronic filing in the first- and second-level courts across the country, the Supreme Court (SC) ordered.

In a resolution, the SC has included cases concerning the declaration of absolute nullity of marriage and annulment of marriage in the scope of Rule 13-A, which mandates the electronic filing for civil cases.

Absolute nullity of marriage and annulment of marriage, which is classified as special proceedings, were initially not covered by the mandatory electronic filing.

However, the SC said the litigation of such cases “is procedurally similar to the prosecution of civil actions.”

The resolution was published in The STAR on April 24.

Meanwhile, Department of Social Welfare and Development Assistant Secretary Ada Colico said the Expanded Solo Parents Welfare Act that took effect in June 2022 includes in its salient features couples whose marriage have already been “annulled” by courts.

Under the new law, a legal guardian, adoptive parent, foster parent and relatives who take care of unparented children are also “recognized.”

Colico said solo parents are qualified to enjoy benefits, such as a 10-percent discount for milk, diapers, vaccinations and medical supplements and at least P1,000 monthly subsidy from their local government units. – Delon Porcalla
