College teacher sued for breaching contract
CEBU, Philippines - A college teacher is facing charges before the Regional Trial Court for allegedly breaching his contract with the Carcar City College.
Carcar City Mayor Nicepuro Apura, through lawyer Brenda Lyn Babao-Bajao, filed a civil case for breach of contract with damages against Luiscel Teofi Cabico for his alleged failure to report to the Carcar City College after November 15, 2012, without due notice.
“Defendant pre-terminated the contract without any written notice as contained in the Contract. Such pre-termination without notice in writing at least 30 days before its date of effectively and without any valid cause breached paragraph 3 of the said Service Contract,” the complaint read.
The City of Carcar and Cabico entered into a Contract of Service, wherein, the latter will teach at the Carcar City College from June 2012 to December 31, 2012.
Apura, however, said Cabico, a resident of Taloot, Argao, Cebu, failed to return to work despite repeated demands to the damage and prejudice to the government and to the students of Carcar City College, who were enrolled in the subjects handled by Cabico.
The city government thus sought for moral, nominal and exemplary dama-ges against Cabico amounting to P250,000.
“Under Article 2220 of the Civil Code, moral damages may be awarded in cases of breach of contract provided that there was fraud or bad faith. The breach committed by defendant was reckless, intentional and abusive. He refused to return to work despite repeated demands,” the complaint read, adding after Cabico left, they did not hear from him anymore.
Apura, likewise, asked the court to order the defendant to pay the costs of suit they incurred.
Cabico is set to answer the allegations filed against him. — (FREEMAN)
