Rob and slay suspect faces charges in court

CEBU, Philippines - The suspect in the robbery and killing of a man during the opening of the Mambaling flyover is facing charges before the Regional Trial Court.

Prosecutor Rogelio del Prado Jr. has found probable cause to elevate to court the complaint of robbery with homicide and physical injuries filed against Jeffery Pulgo.

In his resolution, Del Prado said “upon evaluation of the charges at hand, the undersigned prosecutor is of strong belief that the proper charge would be the special complex crime of robbery with homicide and physical injuries.”

He cited Article 294 of the Revised Penal Code which states that any “person guilty of robbery with the use of violence or on occasion of the robbery, the crime homicide is committed.”

Del Prado said the term “on the occasion” means that the homicide or serious physical injuries must be committed in the course of the robbery.

Pulgo reportedly shot and injured Arsenio Hangin, Jr., and Felix Panugaling, both of Barangay Punta Princesa, Cebu City, who chased him after he allegedly snatched the cell phone of Lovely Hubahib Hangin minutes before the flyover’s opening on April 20.

Pulgo tried to escape on his bicycle but Arsenio and Panugaling chased him on their motorcycle. Arsenio and Panugaling were able to block Pulgo but the suspect shot them with a .357 magnum revolver.

Arsenio was hit in the right side of his body, causing his death days later. Panugaling was hit in the right wrist.

Pulgo was apprehended by the policemen. – (FREEMAN)
