Judge orders Ivler's transfer to Quezon City Jail

MANILA, Philippines - The Quezon City Regional Trial Court approved yesterday the request of the National Bureau of Investigation the transfer of road rage murder suspect Jason Aguilar Ivler to the Quezon City jail as soon as he is discharged from the hospital.

Quezon City Judge Alexander Balut granted the NBI petition for Ivler’s transfer once he gets a clean bill of health from the Quirino Memorial Medical Center (QMMC) to the city jail.

Lawyer Angelito Magno, chief of the NBI Special Action Unit, told reporters that the court has issued a commitment order for Ivler’s transfer to the Quezon City Jail as soon as he is discharged from the hospital. “The court has issued a commitment order to the Quezon City jail the moment he is discharged from the hospital,” said Magno.

NBI Director Nestor Mantaring said the NBI would abide by the court order. The NBI had filed yesterday morning at the Quezon City Prosecutor’s Office criminal charges against Ivler and his mother Marlene Aguilar, for “complex crime of direct assault with frustrated murder” and “complex crime of direct assault for attempted murder.”

The charges against Ivler and Aguilar were filed after two NBI agents were wounded during service of a warrant of arrest against the road rage murder suspect in the Aguilar residence at Blue Ridge Subdivision in Quezon City on Jan. 18.

Magno and Special Investigator Anna Lira Laba of the Office of the Deputy Director for Intelligence Service were wounded during the shootout with Ivler. Ivler was also wounded and is now confined at the QMMC.

The NBI said Aguilar allegedly communicated with her son using a mobile communication device during the raid at their house in Blue Ridge. NBI officials said that because of this, Aguilar was charged as an “accomplice” in the case.

The NBI had charged Aguilar earlier with “obstruction of justice” for giving the NBI false information that Ivler was in Hawaii, which misled authorities in their investigation.

Moreover, the NBI had cited security reasons for seeking Ivler’s transfer to a facility other than the bureau’s jail in Manila.

Ivler was also charged with murder earlier for the killing of Renato Victor Ebarle Jr., son of Malacañang Undersecretary Renato Ebarle Sr., during a traffic incident in Quezon City.

QMMC doctors were also ordered to submit a medical report on Ivler within five days to the court.

Ivler was arrested for the Nov. 18 killing of Ebarle Jr., over a traffic altercation.

He remains confined at the QMMC and is expected to stay longer after undergoing another operation just recently.

The Quezon City Regional Trial Court has scheduled the arraignment of Ivler on Feb. 9.   – With Perseus Echeminada
