The Commission on Elections announces that the commission, sitting as en banc, affirmed the decision of its Second Division to cancel the registration of An Waray Party-list in relation to the 2013 National and Local Elections.
On June 2, the Second Division canceled the registration of the party-list when it arrogated upon itself the authority to have lawyer Victoria Isabel Noel, its second nominee, sit as a Representative in the House of Representatives (HoR) in the 16th Congress "without a Certificate of Proclamation, thus having no legal basis to do so, in violation of the laws, rules or regulations relating to elections."
The poll body says it then revolved to dismiss the Motion for Reconsideration filed by An Waray because it failed to present any "exceptional circumstance" or "compelling reason" to warrant the reversal or modification of the Assailed Resolution.
