'Bastusan ng konstitusyon': Mga grupo sinagot 2022 VP bid ni Duterte
MANILA, Philippines — Kaliwa't kanang pagpalag ang kinaharap ni Pangulong Rodrigo Duterte matapos lumabas ang balitang tuloy na tuloy na ang pagkandidato niya sa pagkabise presidente sa 2022.
Ngayong Martes kasi nang kumpirmahin ng isang paksyon ng PDP-Laban na tinatanggap na ni Digong ang pagtakbo sa ikalawang pinakamataas na elective position sa Pilipinas — na siyang papalit sa presidente kung hindi makagampan sa tungkulin.
Kasabay ito ng usap-usapang tatakbo sa pangulugan ang anak niyang si Davao City Mayor Sara Duterte-Carpio, na kasalukuyang nangunguna sa Pulse Asia survey.
Hindi naman na nagulat dito ang opposition coalition na 1Sambayan, na balak ding mag-field ng sarili nilang mga kandidato pagdating ng 2022. Gayunpaman, kwestyonable raw ito kung batas ang pag-uusapan.
"It shows a clear mockery of our Constitution and democratic process... The candidacy is both legally and morally wrong, and we trust that the Filipino people will realize his brazen, selfish and self-serving motives," ayon sa koalisyon.
"1Sambayan is more determined in unifying the democratic forces and in responding to the challenge to present an alternative candidate for the May 2022 election."

Dagdag pa ng grupo, ginagawa ito ni Duterte para maiwasan ang pananagutan sa International Criminal Court (ICC) at sariling justice system. May umiiral kasing "presidential immunity" para sa mga naluluklok bilang presidente. Walang ganoon para sa bise presidente.
Matatandaang inirerekomenda ng kabababa lang na ICC prosecutor Fatou Bensouda na imbestigahan na si Duterte para sa "crimes against humanity" dahil sa pagpapatupad ng madugong war on drugs.
"Sukdulan talaga ang kasakiman ni Duterte sa kapangyarihan. Palibhasa'y limpak limpak na salapi ang naimbak mula sa kaban ng bayan at hawak niya sa kamay ang batas, ito ang Duterte Legacy na hindi niya mabitawan. Kaya kasapakat ang PDP-LABAN, naghahangad siyang tumakbo muli para sa pansariling interes," wika naman ni Kilusang Mayo Uno chairperson Elmer Labog.
"Sawang-sawa na ang taumbayan sa palpak na pamamalakad ni Duterte sa loob ng limang taon. Nilugmok tayo ni Duterte sa kahirapan, kagutuman, kapariwaraan ng ating mga kababayan at pagsanla sa ating pambansang kalayaan at soberanya! Hindi na ito dapat palawigin pa."
Tugon naman ni Sen. Risa Hontiveros, isang "E di wow."
"Every party has its own process of candidate nomination. But it seems some gatekeepers in PDP-Laban have turned Ka Nene’s original party into a 'zombie' institution which is only performing rituals empty of substance and principle," dagdag pa niya.
Binanggit ni Hontiveros binalot ng drama ang pag-deklara ni Duterte na tatakbo siyang pangulo sa halalan noong 2016 at na mukhang ganoon din ang mangyayari sa pagtatapos ng kanyang termino.
"In any case, it is still early in the day. Perhaps, by midnight the president would have changed his mind at least four to five times."
Duterte pwede ba talaga tumakbong VP?
Kung titignan ang Section 4, Article VII ng 1987 Constitution, sinasabing bawal tumakbo para sa reelection ang isang pangulo:
"The President and the Vice-President shall be elected by direct vote of the people for a term of six years which shall begin at noon on the thirtieth day of June next following the day of the election and shall end at noon of the same date six years thereafter. The President shall not be eligible for any re-election."
Gayunpaman, kung mananalong bise presidente si Duterte, maaari uli siyang maging pangulo kung mamamatay, magkakaroon ng permanent disability, matatanggal sa tungkulin o magbibitiw ang mananalong pangulo sa 2022.
Dahil diyan, binabatikos ng ilan ang ligalidad ng pagtakbo niya sa posisyon, na tila pag-ikot daw ni Duterte sa Saligang Batas.
"The Constitution says you cant be president twice. [Duterte] can't do indirectly what the constitution prohibits indirectly. Worse you won't have immunity as VP," ani Bayan Muna party-list chairperson Neri Colmenares, na siya ring abogado, kanina.
"Your DOJ admitted this when it filed Sedition case against VP Robredo. Ano ulit yon, the sauce for the goose is also the sauce for?"
Ayon naman kay Far Eastern University Law Dean Mel Sta. Maria, talagang hindi pwedeng tumakbo si Duterte sa parehong presidential at vice presidential post. Aniya, tumutukoy daw ang salitang "any" pagdating sa re-election sa dalawang posisyon dahil binanggit ang dalawa sa mga naunang pangungusap.
"In other words, the President shall not be eligible to run for reelection for 'any' of the positions: either the Office of the President or the Office of the Vice President," wika niya nitong Hunyo.
Sa kabila ng lahat ng ito, naninindigan ang Integrated Bar of the Philippines (IBP) na hindi pinagbabawalan ng konstitusyon si Duterte na gawin ang nais.
"The Constitution does not explicitly prohibit a president from running for another office after his term as president. What it prohibits is reelection," ani IBP president Domingo Cayosa.
Lacson, Sotto wapakels; tuloy ang plano
Hindi naman daw makakaapekto ang deklarasyon ng PDP-Laban sa napipintong pagtakbo nina Sen. Panfilo Lacson at Senate President Vicenente Sotto III sa pagkapresidente at pagkabise sa 2022.
"It won't matter to my and Senate President Sotto's determination to run in the May 2022 national elections. We have already declared, and at this point in time, there is no turning back," ani Lacson kanina, na siyang pumupuntirya sa presidential position.
"That said, we continue to hope that the electorate will not be swayed by entertainment politics, nor affected by fear and intimidation when they choose our country's next leaders."
Ngayong Agosto lang nang magpahayag si Sen. Sherwin Gatchalian na nais niyang tumakbo sa pagkabise presidente sa 2022, kahit na kapartido niya sa Nationalist People's Coalition (NPC) si Sotto, na ugong-ugong na tatakbo para sa parehong posisyon. — may mga ulat mula kay Bella Perez-Rubio
