Groups file petition vs SIM registration
MANILA, Philippines — Several organizations have filed a petition against the National SIM Registration Law before the Supreme Court (SC) to declare it unconstitutional and suspend its implementation, arguing that it impinges on rights enshrined in the 1987 Constitution.
Individuals belonging to the National Union of Journalists of the Philippines, Bagong Alyansang Makabayan, Bayan Muna, Pambansang Lakas ng Kilusang Mamamalakaya ng Pilipinas, Kilusang Magbubukid ng Pilipinas and other groups yesterday filed a petition for certiorari before the SC, alleging that Republic Act 11934 infringes on four sections of the Constitution’s Bill of Rights.
In the 59-page petition, the organizations asked the SC to declare the SIM Registration Act unconstitutional and issue a temporary restraining order to stop the government and telecommunications companies (telcos) from implementing the law while the high court deliberates on their petition.
Aside from this, they also asked the SC to order all telcos to cease and desist from “using, storing, transferring and processing all information gathered into the SIM Register and to destroy data already gathered.”
The petition is hinged on four main arguments that assail how mandatory SIM registration restricts the constitutionally guaranteed freedom of speech and violates the right against unreasonable searches and seizures and the right to substantive due process.
