Para di mamiligro ang supply… FPIC oil pipeline buksan na – CA

MANILA, Philippines - Inatasan ng Court of Appeals ang pipeline ope­rator na First Philippine Industrial Corp. (FPIC) na magsumite ng certification sa Department of Energy na nagpapatunay na ligtas nang gamitin ang pipeline para sa commercial operation.

Dahil dito, nasa kamay na ngayon ng DoE ang muling pagbubukas ng 117 kilometer Batangas-Manila fuel pipeline na nagsu-supply ng may 60 porsiyento ng langis sa Metro Manila.

Sa rekomendasyon ng dating 11th division ng CA para sa Supreme Court noong December 21, 2012, inutos nito sa FPIC na magsumite ng naturang certification.

Ini-refer ng Korte Su­prema ang writ of kali­kasan na ipinalabas la­ban sa pipeline noong November 2010 sa CA para sa mga karagdagang pagdinig upang ma­­ batid kung dapat bang tulu­yang isarado ang pipeline o payagang muling makapag-operate.

“The Court recognizes the importance of pipeline for a more effective and cheaper distribution of petroleum products to end-users. Nonetheless, the right of the people, including generations yet unborn to a balanced and healthful ecology cannot be sacrificed in the name of progress,” ayon sa bahagi ng desisyon ng CA na pinonente ni Associate Justice Fernanda Lampas Peralta na sinang-ayunan nina Associate Justices Mario Lopez at Socorro Inting.

Kung mabibigo ang FPIC na magsumite ng certification mula sa kalihim ng DoE sa loob ng 60 araw mula nang magpala­bas ng notice ang SC na nagkukumpirma sa desisyon ng CA, magrere­sulta ito sa permanenteng pagsasarado ng pipeline.

“We accept the court’s decision and will abide by its directives. FPIC has been working closely with government agencies and has always complied with government regulations concerning its efforts to ensure the pipeline’s integrity and restore the environmental health of the areas affected by the pipeline leak in Bangkal, Makati,” ayon sa statement ni FPIC president Anthony M. Mabasa patungkol sa CA report.

Noong March 2012 nagsumite ang DoE ng limang pahinang manifes­tation sa CA na nagre­rekomenda sa muling pagbubukas ng FPIC pipeline matapos ang iba’t ibang pressure at leak tests noong December 2011 na nagpapakita ng structural integrity ng pipeline. Kabilang sa mga nagdeklara na ligtas gamitin ang pipeline ang UP-National Institute of Geological Sciences, UP Institute of Civil Engineering at Societe Generale de Survellance.

Sinabi rin ni noo’y Energy undersecretary Jose Layug sa CA na ang pipeline pa rin ang pinaka-ligtas at pinaka-maaasahan na paraan ng pagde-deli­ver ng produktong pe­trolyo.
