Constitutional crisis kuno

Hinaut nga dili kini mahitabo sa atong nasud, kining gikabalak-an ni Senate President Migz Zubiri nga constitutional crisis, diin matud niya: ‘is creeping in Congress as the House of Representatives continues to push for a people’s initiative aimed at amending the Constitution, that the ongoing signature drive is flawed and unconstitutional.”

Ambot ngano man usab nga ang atong mga representante sa Lower House nangugat man niining  ‘people’s initiative” nga sila ang nag-initiate, ug dili ang people?  

Nagpasidaan nang daan si Zubiri bahin niini, apan, matud niya: “But unfortunately, it seems that this is slowly happening.”

Literally, hinay-hinay kitang nagpadulong sa krisis sa atong Konstitusyon.

Naglaom si Zubiri nga kapugngan pa kini sa labing dali nga panahon.

Sa iyang bahin, si Senador Aquilino Pimentqal III, ang Senate Majority Leader, namahayag nga ang “people’s initiative to amend the Constitution might be challenged by the Senate before the Supreme Court.”

Samtang si Retired Supreme Court Justice Antonio Carpio, midason sa kabalaka ni Zubiri, sa iyang pag-ingon nga ang gilaraw nga mga amendments sa Batakang Balaud, “would lead to a constitutional crisis. 

Ato kining kutluon: “Former Supreme Court Associate Justice Antonio Carpio raised a red flag over the proposed People's Initiative (PI) on constitutional amendments, claiming it would lead to a constitutional crisis.”

Natural, kay matud pa, ang gi-initiate nga people’s initiative (PI) nga dili ang people maoy nag-initiate, buot man gayud nila nga ipadayon ang Cha-cha, basi sa mga pirma o signatures sa katawhan nga buot ipahigayon ang Cha-cha.

Adunay pangutana kon kinsa ang nag-initiate sa signature campaign, ang people ba gayud? Otherwise, kon dili ang people maoy nag-initiate, kinsa man diay? Unya, inig-submit na sa pinirmahan nga nga mga forms, ngadto sa Comelec for validation, di ba klarohon man sa Comelec kinsa ang nagpapirma, ug giunsa pagpapirma?

By the way, ang PI mismo, dili man illegal. Atong kutluon ang Constitution bahin niining lain nga paagi pag-amend sa constitution:

“Amendments to this Constitution may likewise be directly proposed by the people through initiative upon a petition of at least twelve per centum of the total number of registered voters, of which every legislative district must be represented by at least three per centum of the registered voters therein.”

Sa nasayran na, tulo ka paagi paghimo’g kausaban sa konstitusyion: 1) Constitutional Convention (ConCon), diin magpili kita’g delegates to the convention; 2) Constituent Assembly (ConAss), diin sila rang mga sakop sa Kongreso ang mo-deliberate o mo-toki kon unsa nga mga amendments ang angayan o kinahanglan himuon; ug 3) People’s Initiative (PI).

Giklaro sa constitution, nga ang katawhan maoy mo-propose paghimo’g kauaban sa konstitusyion “through initiative by the people.”

Mao kini karon ang dakung tanghaga nga kining ilang gipalakaw karon nga people’s initiative, tinuod ba gayud nga ang people maoy nag-initiate?

Laing pangutana, mapalit ba ang lungsod? Tubag ni Jarius Bondoc sa iyang column sa The Philippine Star: “No need to worry about mass protests. Fifty percent of Filipinos are poor, and 30 percent are near poor – all willing to exchange democratic rights for some cash handout. “

Kuyaw no?
