Pagbasura ng Comelec sa disqualification case ni Tulfo, pinagtibay ng SC

MANILA, Philippines — Pinagtibay ng Supreme Court (SC) ang desisyon ng Commission on Elections (Comelec) na nagbabasura sa disqualification case na isinampa kay Senator Raffy Tulfo bunsod ng kawalan ng hurisdiksiyon.

Sa desisyon ng SC noong Abril 3, na inilabas lamang sa media kamaka­lawa, pinaburan nito ang posisyon ng Comelec en banc na wala na itong hurisdiksyon sa disqualification case na isinampa laban kay Tulfo dahil hawak na ito ng Senate Electoral Tribunal (SET).

Anang SC, “The Court, citing Section 17, Article VI of the Constitution, and established jurisprudence, clarified the division of po­wers in election disputes. It stated that once a winning candidate had been proclaimed, taken oath, and assumed office, the Comelec’s jurisdiction over election contests relating to their election, returns, and qualifications ceases, and the SET assumes jurisdiction. Pearson failed to timely file the appropriate case before the SET and cannot remedy this failure by invoking the Court’s certiorari powers.”

Nauna rito, hiniling ni Julie Licup Pearson na madiskuwalipika si Tulfo dahil convicted ito sa libel, na isang krimen na kinasasangkutan ng moral turpitude.

Inakusahan din niya ang senador na sangkot sa isang election offense matapos na ilegal na i-advertise ang kanyang kandidatura sa kanyang programa sa radyo.

Sinabi naman ng SC na iniapela ni Pearson ang pagbasura sa disqualification case laban kay Tulfo sa Comelec matapos manalo na ito sa 2022 senatorial elections.

Iniakyat naman ito sa SC sa pamamagitan ng isang petition for a certiorari matapos na ibasura ng Comelec ang kanyang apela o motion for reconsideration.
