City to check fence in Kasambagan

CEBU, Philippines - The Cebu City’s Office of the Building Official will send a team to Barangay Kasambagan to inspect a fence in J. Panis Street that was allegedly constructed illegally.

“I will send a team to inspect the area kay initially, ni agree na ang owner nga ipakuha ang fence. So, atong i-check,” said OBO chief Engr. Jose Marie Poblete yesterday.

The owner of the fence, Richard Unchuan, was ordered to remove the fence as it bars residents from going to Governor M. Cuenco Avenue.

“This is to inform you that you have made an illegal construction of fence in violation to section 501 of the National building code PD 1096,” the notice of violation reads.

OBO inspected the area after at least 70 residents of St. Michael Village complained.

The fence was put up in September last year but was removed by November 1. It was, however, back after All Saints’ Day and All Souls’ Day.

Area inspector Christopher Miranda asked Unchuan to secure a building permit for the structure.

Poblete said Unchuan has written his office and explained that the structure is not actually a fence.

“Sa ilang explanation, ingon sila wala mikuha og permit kay dili daw to fence and they were not the one who constructed it,” Poblete said.

Despite the explanation, Unchuan still agreed to tear the fence down.

Meanwhile, Apas Barangay Captain Ramil Ayuman, the one the complaints approached first, said he sent a copy of the notice of violation to the Land Management Council.

“Atty. Ponce told me nga mag-issue og resolution ang LMC recommending sa pag-abli sa road,” Ayuman said, referring to LMC head lawyer Janeses Ponce.
