MARINA employee asks court to stop enforcement of dismissal

CEBU, Philippines - An employee of the Maritime Industry Authority (MARINA) 7 is asking the court to stop her bosses from implementing an order of dismissal against her.

Engineer Lilah Rodas filed the injunction case against MARINA Administrator Emerson Lorenzo and Director Nanette Dinopol.

It was the Office of the Ombudsman-Visayas that ordered the MARINA officials to implement the dismissal order after it found Rodas guilty of dishonesty for her failure to declare her Statement of Assets, Liabilities and Net Worth (SALN) for 1999, 2000, 2001 and 2003.

It was the Public Assistance and Corruption Prevention Office (PACPO) of the Office of the Ombudsman that filed the dishonesty case against Rodas.

In her case in court, Rodas argued that the MARINA officials cannot implement the Ombudsman decision just yet because the same is not yet final and executory. The Ombudsman, she said, is yet to rule on her motion for reconsideration and a supplemental motion for reconsideration.

Despite this, Lorenzo reportedly issued a memorandum on August 11, 2011 directing Dinopol to immediately implement the order of dismissal.

“The plaintiff is willing to put up a bond executed to the adverse party in the amount fixed by the court in its order granting the issuance of the writ, conditioned that the latter will pay all the cost which may adjudge to the adverse party,” Rodas said.   - (THE FREEMAN)
