DOLE chief tells employers to observe pay rules for Bonifacio Day

MANILA, Philippines – Department of Labor and Employment Secretary Rosalinda Dimalipis advised employers to observe pay rules for the Bonifacio Day on November 30.

Baldoz reminded employers of regular non-working holiday pay rules as Filipinos mark the 152nd birth anniversary of Andres Bonifaco on Monday.

She said the holiday was declared by virtue of Proclamation No. 831 issued by President Benigno Aquino III on July 17, 2014.

“The nationwide holiday, known as Bonifacio Day, is being observed yearly in honor of the 'great plebeian', Andres Bonifacio, whose birth date is 30 November 1863. I urge our private sector employers to observe the pay rules and core labor standards applicable on that day for our workers’ welfare and protection,” Baldoz said in a statement.

 The Bonifacio Day pay rules are as follows:

•        When the holiday falls on an employee’s regular workday:

- If the day is worked, the employee is entitled to 200 percent of his or her basic wage on the first eight hours.  For work in excess of eight hours, he or she is entitled to an additional 30 percent of his or her hourly rate on the said day.

- If unworked, the employee is entitled to 100 percent of the regular daily rate, provided he or she was present, or was on leave with pay, on the workday immediately preceding the holiday.

•         When the holiday is the employee’s rest day:

- If the day is worked, he or she shall be paid an additional 30 percent of 200 percent on the first eight hours, and plus 30 percent for work in excess of eight hours on the said day.

- If unworked, the employee is entitled only to 100 percent of his or her regular rate, provided he or she was present, or was on leave with pay, on the workday immediately preceding the holiday.

•         When the day immediately preceding the holiday is a non-work day in the establishment:

- In case the day immediately preceding the holiday on November 30 is a non-work day in the establishment, or is the scheduled rest day of the employee, the employee shall not be deemed on leave of absence on that day, in which case he or she shall be entitled to the regular holiday pay.
