3 soldiers face charges for torture of Abu suspect

MANILA, Philippines - The Armed Forces’ Western Mindanao Command (Wesmincom) has found enough grounds to file criminal cases against three of the four soldiers tagged in the torture of a suspected Abu Sayyaf member in Basilan.

Armed Forces of the Philippines (AFP) spokesman Commodore Miguel Rodriguez said this was the result of a probe conducted by the Wesmincom on the alleged torture incident that happened last July 23.

The three soldiers – Army Capt. Sherwin Guidangen, S/Sgt. Elmer Magdaraog and Sgt. George Awing – are also facing possible dismissal from the service.

“Western Mindanao commander Gen. Raymundo Ferrer has approved the recommendation of the investigating team of Wesmincom... finding sufficient grounds for the filing of criminal charges against one officer and two enlisted personnel with regards to the violation of the anti-torture law,” Rodriguez said.

On the other hand, the Wesmincom cleared Sgt. Edgardo Santos of allegations that he took part in the torture incident.

Rodriguez said Guidangen, Magdaraog and Awing may face charges before the military court martial and the civilian court.

He said Guidangen, being an officer, would be referred to the AFP Efficiency and Separations Board to determine if he is still fit to remain in service.

Magdaraog and Awing, being enlisted personnel, will be subjected to summary dismissal proceedings pending the deliberations on their cases.

If proven innocent, the enlisted personnel may return to service with corresponding back pay.

The three soldiers were accused of torturing a suspected Abu Sayyaf member identified as Abdul Khan Ajid in Tabiawan, Basilan last month.

Ajid, who is said to be facing kidnapping and illegal detention cases, was reportedly arrested by members of the Army’s Scout Rangers Company in Tabiawan on July 23.
