2 men sued for estafa

CEBU, Philippines - Two men alleged to be behind the four missing container vans at the Cebu International Port that contained used tires were charged for estafa before the Cebu City Prosecutor’s Office.

Rodel Descallar, a resident of Pusok, Lapu-Lapu City, was sued by Jaime Vicente Amparado, who allegedly paid him to facilitate the purchase and shipment of rubber tires from Japan, which reportedly turned out to be those reported missing at the CIP.

Another respondent, Joselou Garcia Povadora, was alleged to be responsible for the withdrawal of the shipment from the CIP. 

Amparado, owner of JV Tire Supply and Magwheels, was accompanied by lawyer Eduardo Gaanan in filing the complaint yesterday.

“That through the verbal representation of respondent-Descallar, he persuaded me and I was convinced that he could facilitate for me the purchase of various rubber tires from Japan for a total Broker’s fee of P500,000,” the affidavit-complaint read.

Amparado alleged that through Descallar’s “false pretenses,” he was convinced that the latter could purchase rubber tires direct from Japan and can have these shipped to Cebu City and sent directly to his warehouse.

“That sometime in the months of June and July 2015, the aforementioned shipment of rubber tires arrived in my warehouse as evidenced by the following commercial documents as issued by the Bureau of Customs, Cebu City,” he stated.

 Amparado claimed that it was Povadora, also a resident of Pusok, Lapu-Lapu City, who withdrew the shipment from the port. 

However, on October 28, Amparado alleged agents of the Bureau of Customs raided and then padlocked his warehouse after finding at the establishment the four missing vans which contained used tires.

Amparado told The FREEMAN he was just a victim, saying he has nothing to do with the missing containers vans at CIP.

“For 30 years in doing business, it is my first time that my name was dragged,” he lamented.

He stressed that all his transactions were valid and that he has proofs to show.

The respondents are set to answer the allegations filed against them.— (FREEMAN)
