Carpenter charged for attempt to kill German

CEBU, Philippines - A carpenter was charged for allegedly attempting to kill a German national who was on a motorcycle along the road at Sitio Palwa Maria, White Road, Barangay Inayawan, Cebu. 

Prosecutor I Ricky Jones Macabaya elevated the complaint filed by Zarko Ljiljak alias “Freddie” against Juan Ordinesa for frustrated murder after finding probable.

Macabaya recommended P40,000 for Ordinesa’s temporary liberty.

Ljiljak, 45, is a native of Zettelsdorf 3, Bamberg Warsdorf, Germany and temporarily residing at Sitio Palwa Maria. He stated in his affidavit that in April 27, 2010 at around 11:00 a.m., he was on his motorcycle on his way home after buying fruits when he saw a man talking to kids beside the road.

When he reached the area near the man, whom he later learned was Ordinesa, he saw something from the waistband of Ordinesa who then raised his arm. Thinking nothing was unusual, the German just continued on his way.

Ljiljak said that seconds later, he heard a burst of gunfire which he initially thought was firecracker. But when he saw sparks near his motorcycle, he turned his head and saw the man shooting at him successively.

“I accelerated my speed then went straight through the open gate of the compound where I lived and went inside my house where I felt down on the entrance door due to the gunshot wound on my right buttock,” Ljiljak said

Ljiljak was rushed to hospital by his live-in partner, Roxine Matimatico and some neighbors. Ljiljak underwent surgery.

After checking out of the hospital he continued his medication at home and left for Germany on May 8, 2010 and returned to the Philippines on June 12, 2010 after he learned from his live-in partner that the man who shot him was arrested.

Prosecutor Macabaya said he sent a subpoena to Ordinesa but no counter-affidavit was submitted to his office, which led him to resolve the complaint.

“This case will be resolved on the basis of evidence presented by the complainant as accused is deemed to have waived the presentation of his evidence,” Macabaya said. (FREEMAN)
