AFP pinalagan ang SOGIE bill sa Kamara, 'tatapakan' daw ang karapatan ng karamihan

MANILA, Philippines — Kinastigo ng Armed Forces of the Philippines (AFP) ang panukalang batas na Sexual Orientation and Gender Identity Expression (SOGIE) bill sa Kamara de Representantes — na layong bigyan nang patas na pagtrato ang mga lesbian, gay, bisexual, transgender (LGBT) atbp.

Ang anunsyo ay inilabas ng militar sa pamamagitan ng position paper na isinumite sa House Committee on Women and Gender Equality, sa dahilang protektado na raw ang nasabing sektor ng 1987 Constitution atbp. batas.

"The Armed Forces does not subscribe to the passage of the SOGIE bill. The AFP does not discriminate anybody based on sex and gender," wika ng sandatahang lakas.

"As a government institution, the military has existing polices and standard operating procedures protecting personnel from discrimination and harassment. It would be unjust to grant special privilege to some persons at the expense of the basic rights of others."

Sinasabi ito ng AFP kahit na hindi naman nangangahulugang inaagawan ng karapatan ang mayorya oras na bigyan ng patas na trato ang mga marginalized sector.

Matatandaang pumasa sa Kamara ang SOGIE bill noong 17th Congress ngunit hindi tuluyang nakalusot matapos natengga lamang ang counterpart bill nito sa Senado.

"Respect and compassion towards our brothers and sisters in the LGBT community may be given without having to sacrifice the rights of the majority," sambit pa ng AFP.

Aniya, bukod sa konstitusyon ay meron nang Labor Code, Civil Code, Anti-Graft and Corrupt Practices Act, Code of Conduct and Ethical Standards for Public Officials, Revised Penal Code at Anti-Sexual Harassment Act of 1995 para pagpantayin ang turing sa mga kasarian.

Sa 15 panukalang anti-discrimination bills sa Konggreso, itinuturing na "discriminatory" ang mga sumusunod na gawi:

• pagkakait sa serbisyo publiko, pagbabawal sa military service, atbp. sa sinuman dahil lamang sa kasarian
• pagbabawal pumasok o pagsipa sa eskwelahan ng mga estudyante dahil lamang sa sa sexual orientation o gender identity or expression
• pagpaparusa nang labis-labis sa batayang sexual orientation o gender identity or expression
• pagkakait ng access sa pampubliko o pribadong medical services dahil sa usapin ng kasarian

'Hindi pa protektado'

Pinasinungalingan naman ng ilang mambabatas ang tirada ng AFP, lalo na't hindi nangangahulugan na nasa konstitusyon na na maipatutupad na ito.

"The Constitution cannot promulgate itself. It is not a cure-all document. It needs an enabling law to address the specific problems of specific groups," wika ni Bataan Rep. Geraldine Roman, na isang transgender woman, sa ulat ng GMA News.

"That is why we have laws protecting women, senior citizens, cancer patients, and yet we do not have a law against discrimination against LGBTQIA."

Aniya, mas mainam na may ganitong tipo ng batas upang matiyak na may ligal na sandigan sa pagrerespeto sa kapwa-tao.

Ayon naman kay Bukidnon Rep. Maria Lourdes Acosta-Alba, hindi raw ito basta magbibigay ng "espesyal na pribilehiyo" sa LGBT ang SOGIE bill, ngunit pipigil sa harassment at bullying. — James Relativo
