Man charged for “stealing” ex-partner’s motorcycle

CEBU, Philippines - The prosecutor’s office has indicted a 27-year-old man for allegedly stealing the motorcycle of his former live-in partner.

Prosecutor II Eulogio Borres, Jr. held Petches Cariñosa, a resident of Sitio Cogon, A. Lopez St., Barangay Labangon, Cebu City, for trial for violation of Republic Act 6539, otherwise known as the Anti-Carnapping Act.

“On the basis of the sworn statement and other documents submitted before me there exists a reasonable ground to believe that the crime has been committed and that the accused is probably guilty thereof,” read the document.

Borres recommended P200,000 bail for Cariñosa’s temporary liberty.

Mithosela Daclan, 23, a resident of Barangay Labangon, alleged that her former live-in partner carted away her Yamaha Mio Sporty motorcycle worth P115,000.

She alleged that while she was still living with Cariñosa, she told him not to use her motorcycle.

“On August 5, 2014 while I and Petches were living together at Sitio Cogon, Barangay Labangon, Cebu City, I told him not to use my motorcycle anymore because I wanted to return it to the store where I bought it since I could not pay its monthly installment,” she stated.

However, he said Cariñosa drove it away and when he returned home, the motorcycle was not with him anymore.

Daclan alleged that Cariñosa did not tell her where he left the motorcycle and they ended up arguing with each other.

On October 2, 2014, she said that she decided to leave Cariñosa for good and moved to her mother’s house along with her two children.

Daclan said she met Cariñosa on October 10, 2014 and asked for him to return the motorcycle, but he refused.

Borres ordered Cariñosa to file his counter-affidavit to negate the allegations filed against him, but he failed. Thus, Borres resolved the complaint based on the evidence of Daclan.

“Wherefore, finding probable cause, let information for carnapping not theft be filed against respondent in the proper court,” read the resolution. — Mylen P. Manto/ATO (FREEMAN)
