MANILA, Philippines — Nilinaw ng isang legal medicine expert kahapon na walang batas na nagbabawal sa mga doktor na magmay-ari o mamuhunan sa private ventures tulad ng paharmaceutical at medical device companies, mga ospital at diagnostic centers.

“As long as doctors comply with all legal requirements including disclosure of potential conflicts of interest – if specifically mandated – I hold the view that medical doctors are not prohibited from engaging in business,” anang doctor-lawyer na si Atty. Antonio D. Rebosa.

Inihayag ito ni Rebosa, ang nag-iisa at kauna-unahang Filipino board-certified Diplomate ng American Board of Legal Medicine, upang tulungan linawin ang legal at ethical issues sa healthcare professionals’ investments sa healthcare industry kaunay sa patuloy na Senate inquiry sa marketing practices ng Bell-Kenz Pharmaceutical, Inc.

Sinabi niya na sa lectures sa medical societies, forums at healthcare professionals, madalas siyang tanungin tungkol sa legality at ethical aspect ng mga doktor na nakikibahagi sa negosyo at tumatanggap ng mga perks at insentibo mula sa mga kumpanya ng gamot na nakikinabang sa kanilang mga kagustuhan sa pagrereseta.

“Medical professio­nals, like any other individual, have the right to invest in any sector, including healthcare. Such investments do not inherently violate any legal or ethical standards,” pagdidiin niya.

Ang essence aniya ng ethical medical practice ay kung hindi makokompromiso sa pagmamay-ari ng kaugnay na negosyo, ang pangunahing interes na kapakanan para sa pasyente.

“The key is managing­ potential conflicts of interest effectively,” aniya. “This can be achieved through transparency, proper disclosure, adhe­rence to strict guidelines, continuous education, and robust monitoring by medical associations.”

Sinabi ni Rebosa na ang kanyang malawak na pagsusuri sa mga kaugnay na batas kabilang ang Revised Corporation Code, Securities Regulation Code, the Medical Act of 1959, Food and Drug Administration Act, Gene­rics Act, Universal Health Care Law, at Consumer Act of the Philippines, ay nagkumpirma na ang mga pamumuhunan ng mga manggagamot sa mga pharma firm at healthcare facility ay legal na pinahihintulutan.

Aniya, ang Senate Inquiry ay nagbigay-daan para makita na may pangangai­lanan pa sa mas detalyadong Continuing Medical Education (CME) para sa ethical practices  at conflict of interest management.

Hinikayat niya ang medical associations na palakasin ang kanilang polisiya at educational initiatives para matiyak na manatiling may kaalaman at sumusunod sa ethical standards.
