A matter of fairness of the law
Now it is Duterte and Miriam, both may have missed the rationale behind the International Law on foundling:
Why does the International Law rules that a foundling is a natural born citizen of the country the foundling is born? There is the unavoidable possibilities that the parent, particularly mother, is a native of that country. One rationale is this: no foreign parent, particularly the mother, would journey to another foreign country, bear a child there, abandon the child, exposed to the element (Solomon wisdom) (99% NO). Only a native mother, (with or without foreign father) extremely poor with no means of support would do that. That is why, the foundling is adopted a natural born citizen of that country where he/she is born…like Grace Poe, baptized “Grace” by a priest in Iloilo, brought to the attention of no less than the late Cardinal Sin.
Her length of residency, according to Supreme Court decision, penned by Justice Kapunan, is based on fact of residence, and not on written oath on COC, which error committed is excusable, like in the case Imelda Marcos vs Comelec. Grace Poe attended the funeral of her father, the King, in 2004 and never left the Philippines up to 2015.
Circumstantial evidences are acceptable. Pres. Obama was unfortunate, circumstantial evidence was against him, no proof he was born in Hawaii but point to Kenya. In the case of Grace Poe, circumstantial evidences are insurmountable in her favor. Please refer to previous referral.
I sympathize with Grace Poe. It is not good that the many reputable lawyers , including the Hon.Justices and Comelec, Duterte, Miriam, Dean of FEU, etc. are ganging up on her. Overkill. I don’t think Mar Roxas is behind this, as involved are respected reputable independent lawyers.
What did Pres. Noynoy Aquino said: “Let her run.”
