A woman and her lover were sentenced to death yesterday by a Pasig City court for conspiring to kill the formers husband in San Juan eight years ago.
Judge Alex Quiroz, of the Regional Trial Court Branch 156 also ordered Beverly Tibo-Tan and her lover, Rolando Mabiliran, to indemnify the family of the victim, Reynaldo Tan, the sum of P180,000 for actual and moral damages.
In a 17-page decision, Quiroz found sufficient evidence showing that the two accused conspired to kill Tan by blowing up his car to make their relationship legal.
"The treacherous scheme is clear. The victim was unaware of the existence of a bomb beneath the drivers seat of his car which needs a deliberate preliminary planning by having a duplicate key and studies of habits, daily routine and proclivities of the victim," Quiroz said in his decision.
Records showed that on Feb. 5, 1995, Tan fetched his wife and their children at their house in White Plains Subdivision, Quezon City to bring them to the Greenhills shopping complex in San Juan.
While Tan is separated from his wife, he still sees her to go out with the kids. He was reportedly living with another woman at the time.
The family arrived at Greenhills at noon. Tan parked his car, a Honda Accord, at Parking Lot 3 in front of the Unimart supermarket.
Four hours later, the family decided to go home. Reynaldo went to the parking lot to get the car while his wife and children waited near the entrance of Unimart with the grocery items they bought.
But when Tan opened the cars door, a hand grenade exploded. Reynaldo was rushed to the Cardinal Santos Medical Center for treatment but later succumbed due to severe injuries.
Investigator PO1 Wilson Lachica testified that in the course of his investigation, the wife showed no remorse over the death of Tan, something which he described was "unusual."
Lachica found out that days before the incident, the wife had a duplicate key made of Tans car. The key was allegedly used by his lover Mabiliran so he could rig the grenade inside car while the family were out shopping.
In their defense, the duo claimed it was impossible for them to have planted the bomb since they were somewhere else at the time of the incident.
Mabilirans relatives claimed that he was attending the baptismal party of his sisters child and was there until 7 p.m.
In Quezon City, a lower court sentenced yesterday a 26-year-old Chinese national to life imprisonment for selling some 986.36 grams of shabu during a buy-bust operation four years ago.
Po Chuan alias Gilbert Yang, a worker at a ceramics factory, and resident of 1832 Abad Santos street, Tondo, Manila was found guilty beyond reasonable doubt of violating Republic Act 6425, or the anti-illegal drugs law.
The accused was arrested in a buy-bust operation for selling and delivering 986.36 grams of shabu to a poseur-buyer of the then Presidential Anti-Organized Crime Task Force (PAOCTF), on March 23, 1999 at a restaurant on P. Tuazon street, Cubao, Quezon City. Pia Lee Brago
