Nakinabang ang bansa sa DAP - Malacanang
MANILA, Philippines – Muling dinepensahan ng Palasyo ngayong Lunes ang kontrobersyal na Disbursement Acceleration Program (DAP) at sinabing naging mali lamang ito matapos ideklara ng Korte Suprema.
“So it is something that we can stand by, the projects that have benefited the country, and this is all found in the Supreme Court (SC) decision itself,” pahayag ni Presidential Spokesperson Edwin Lacierda.
“You must remember that under the operative fact, prior to the declaration of unconstitutionality, the acts done were valid and legal because there’s a presumption of the acts were done in accordance with law.”
Nitong nakaraang linggo ay idineklara ng mataas na hukuman ang hindi naaayon sa Saligang Batas ang naturang programa.
“This is not a question of whether you have a bad legal advice. It’s a question of the primacy of one institution over the other. We are called to execute the laws. The legislative is called to make laws and the Supreme Court is called to decide and interpret the law in deciding cases,” banggit ng tagapagsalita.
Sa huli ay sinabi ni Lacierda na mula nang gamitin ang DAP hanggang sa ilabas ng korte ang desisyon ay wala itong nilalabag na batas.
“It just so happened afterwards na naging (became) unconstitutional. But during the entire time it was being done, there was a presumption of validity.”
