Pinay maid wins child molestation case in Hong Kong

MANILA, Philippines — The Hong Kong appeals court has ordered the release of a Filipina domestic helper accused of molesting an eight-year-old child after it overturned the lower court’s prior ruling that was handed down based on contradictory and incomplete evidence.

Before winning her appeal, the unidentified Filipina had spent four and a half years in jail after she was accused of forcing her ward to have sex from 2011 and 2013, according to the news report by the South China Morning Post.

Justices of appeal Derek Pang Wai-cheong, Ian McWalters and Andrew Macrae hit District Court Judge Johnny Chan Jong-herng for concluding that the victim may have had confusion in his testimony.

The victim said he was “flaccid” during the alleged rape – a total opposite of the ruling.

The justices added that Chan’s failure to see that the assault charges possibly required acts lesser in gravity than penetration for the Filipina to be convicted led to the reversal of the ruling.

For not guiding the victim to formulate a reliable and consistent account, the prosecutors also got a beating from the court.

The Department of Justice did not request a retrial.
