Ex-agriculture director faces raps over SALN

MANILA, Philippines - A former regional director of the Department of Agriculture (DA) is facing multiple criminal cases over alleged false declarations and non-filing of his Statements of Assets, Liabilities and Net Worth or SALNs for several years.               

In separate case information sheets filed by the Office of the Ombudsman before the Sandiganbayan on May 16, DA-Autonomous Region in Muslim Mindanaon director Basher Noor was charged with three counts of perjury under Article 183 of the Revised Penal Code (RPC).

Basher was also charged with seven counts of violation of Section 8 of Republic Act 6713 or the Code of Conduct and Ethical Standards for Public Officials and Employees.

Noor is accused “making a willful and deliberate assertion of falsehood” in his sworn Statements of Assets, Liabilities and Net Worth or SALNs for years 2003, 2006 and 2011.

Ombudsman's assistant special prosecutor Jorge Espinal said Noor failed to declare in his SALNs for those years his ownership of a 72,093-square-meter-lot situated in Manolo Fortich in Bukidnon covered by a Transfer of Certificate of Title No. T-88286.

Espinal said Noor falsely declared that he only owned three real properties, two were situated in Marawi City and one in Cagayan De Oro City .

As for his breach of conduct cases, the graft probers said Noor failed to file before the Office of the Ombudsman his SALNs for years 2004, 2005, 2007, 2008, 2009, 2010 and 2012 “as required of every public officer under the law”.

The ombudsman set Noor's bail bond at P88,000.

Under Section 8 of RA 6713, public officials and employees must disclose in their SALN “their assets, liabilities, net worth and financial and business interests including those of their spouses and of unmarried children under 18 years of age living in their households.”

The same law requires public officials and employees to file their SALN within 30 days after assumption of office; on or before April 30 of every year thereafter; and within 30 days after separation from the service.
