NGCP seeksto expropriate lot affected by project

CEBU, Philippines - The National Grid Corporation of the Philippines (NGCP) has filed a civil case for expropriation to take possession of a lot situated in Barangay Maghaway, Talisay City for the construction of a transmission line.

NGCP through the Office of the General Counsel seeks to expropriate more or less 1,372 square meter property owned by the heirs of Nolasco Igloria and Dorotea Gabison-Igloria.

The property is needed for the construction of a 138KV transmission line from Colon in the City of Naga.

“Owing to this necessity, plaintiff must immediately construct the transmission lines that will transmit power from the power plants, such as the 246 MW CEDC and 200 MW KEPCO coal-fired power plants, to the distributors of electricity,” the complaint reads.

Named defendants of the petition were Ernesto Igloria, Anastacia Damalerio, Danilo Igloria, Jocelyn Boddington, Brenda Igloria, Rouel Igloria and heirs of Jesusa Hudson with unknown identities and whereabouts.

The NGCP earlier negotiated for the acquisition of “an easement of right-of-way” of a portion of the lot affected by the transmission line project. However the negotiation failed, thus, compelling it to seek the intervention from the court.

The owners refused to sell the property to NGCP at the price offered at P147,287.50.

NGCP asked the court to issue a judgment declaring them as the lawful owner after the payment for compensation will be consummated.  (FREEMAN)
