SC scraps petition vs Comelec’s SOCE extension

MANILA, Philippines – The Supreme Court on Tuesday afternoon junked the petition questioning the Commission on Elections’ decision to extend the deadline of the filing of the statements of contributions and expenditures due to technicalities.

At a televised press conference, SC spokesperson Theodore Te said the court en banc moved to dismiss the motion of the petitioners, retired Army Col. Justino Padiernos of the People's Freedom Party and lawyer Manuelito Luna, for failing to attach the duplicate original or certified true copy of the assailed Comelec resolution along with requisite number of copies required.

Te said the “petitioners have merely submitted a news report in lieu of the required copy of assailed resolution.”

Aside from failing to attach the required documents, the SC found the petitioners having failed to state the exact date of promulgation of the assailed resolution. This makes the claim on the timeliness of petition defective.

The high court cited the Rule 64 Section 5 of 1997 Rules of Civil Procedure which provides requirements for any petition to be considered by the court.

“In sum, the failure of instant petition to comply with these basic requirements constitutes a sufficient reason for its dismissal,” the SC resolution read.

The petitioners earlier asked the tribunal to strike down the Comelec resolution extending the deadline for filing of the SOCE of political parties and candidates for alleged committal of grave abuse of discretion.
