Man sued for teen’s nude photo, sex video

CEBU, Philippines — The Cebu City Prosecutor's Office has charged a man before the court for allegedly reproducing a naked photo and sex video of a college student.

Prosecutor II Jill Ann Paculba-Gealon held Eric Ben Ami Arellano, a resident of Cebu City, for trial for a violation of Section 4(b) of Republic Act (RA) 9995 or anti-photo and voyeurism act in relation to Section 6 of RA 10175 or Cybercrime Prevention Act.

"...the said accused, with deliberate intent, did then and there willfully, unlawfully and feloniously, copy or reproduce, or to cause to be copied or reproduce a naked photo or video or recording of sexual act or any similar activity...with or without consideration, and without the consent," read the information.

Gealon recommended P42,000 bail for Arellano's temporary liberty.

In her complaint-affidavit, a 19-year-old girl sued her ex-boyfriend (name withheld) and Arellano for allegedly threatening and spreading or sharing or uploading her sex video and nude pictures online.

The video, she said, was taken by her ex-boyfriend when they were together.

Arrellano denied the allegations against him and the minor's ex-boyfriend failed to submit his counter-affidavit.

With the foregoing, Gealon resolved the complaint and found probable cause against Arellano.

"The allegations fail to show that respondent copied or reproduced the photo and sex video of the complainant. What is clear though is that respondent, had caused the same to be showed or exhibited through the internet via FB messenger with the end in view of satisfying his lustful desires by demanding from the complainant a posting of her nude photos,otherwise these photos and videos would be uploaded over the internet," read the resolution.
