Woman charged with estafa denies claim against her

CEBU, Philippines —  A 34-year-old woman, who is facing estafa case for allegedly pretending to her Swedish boyfriend that she was single and inducing him to buy her a real property worth P2.5 million in Lapu-Lapu City, denies the charge against her.

Lovely Ann Enad, alias Lovely Anne, told The FREEMAN through Messenger that she did not lie with her civil status to Hans Goran Gunneriusson.

“How come mangilad ko, he knows everything,” she said, adding Gunneriusson knows that she and her ex-husband, Felomino Enad, were already separated for five years before she met the foreigner in 2015.

“(Five) years nami buwag sa akoa ex-husband and Goran knows everything. Mao siya mismo ga-file og annulment ug gabayad,” she said, adding she has all the documents that she did not deceive Gunneriusson.

Enad said the annulment case is still pending.

In his complaint, Gunneriusson alleged Enad claimed to be single in a contract to sell and a deed of absolute sale for the purchase of a real property worth P2,483,960.58, where he supplied the money and Enad acted as the buyer.

Gunneriusson alleged if he had known Enad was married, he would not have dated her and would not go as far as acquiring properties with her.

Prosecutor III Rhodna Alcala-Bacatan summoned Enad to file her counter-affidavit to answer the allegations filed against her but failed.

Thus, she resolved the complaint based on evidence available.

“A subpoena dated September 19, 2017 was issued to respondent, giving her ten days from receipt thereof to file her counter-affidavit. To date, after the lapse of over a month (from its issuance), no counter-affidavit was ever filed. This complaint will now be resolved based on the evidence on record. Pursuant to Rule 112, Sec.3 (d) of the Revised Rules on Criminal Procedure,” read the resolution.

Bacatan found probable cause to elevate the complaint to the court.

City Prosecutor Liceria Lofranco-Rabillas approved Bacatan’s recommendation.

Enad said she failed to file her counter-affidavit because the address supplied before the Cebu City Prosecutor’s Office is wrong.

“My real address is Mactan Plains Subdivision Phase 2, Block 5, Lot 8, Mactan New Town, Lapu-Lapu City,” she said.

When asked what could have possibly motivate Gunneriusson in filing the case, Enad said that it was because she had filed two cases of Republic Act 9262 or Violence Against Women and their Children against the former and the court directed the Bureau of Immigration to include the name of the latter in the hold departure list.

“Kay tungod naa siyay kaso nga duha ka RA 9262 ug nalutsan sya og hold departure order…because kinulata ko niya,” she said, adding she and Gunneriusson separated in 2016. — GAN (FREEMAN)
