Case vs. men who mauled shopper to be filed today

CEBU, Philippines - The National Bureau of Investigation-7 is set to file today a criminal complaint before the Cebu City Prosecutor’s Office against those who allegedly mauled Mario Alfie Ducayag.

Last April 12, Ducayag, 23, a resident of Tuyan, Naga City, Cebu was reportedly beaten to unconsciousness then later died after he was accused of shoplifting of a pair of Sandugo Sandals at the Metro Gaisano Colon.

Based on the autopsy report of Dr. Rene Cam, NBI medico-legal officer, the victim’s cause of death was traumatic nape injury or the dislocation of his cervical vertebrae.

Shantylle, the sister of the victim, told The FREEMAN that she and her mother, Fe Soledad, were satisfied with the efforts made by the NBI during the case conference yesterday.

She said investigator Bernard dela Cruz explained to them the result of their investigation into the death of her brother.

Meanwhile, Dr. Nestor Sator of the Philippine National Police medico legal officer is asking for ten more days to file his counter-affidavit on the complaint filed by Fe Soledad.

Fe Soledad filed a complaint for obstruction of justice and false medical certificate or falsification of a public document against Sator over the “erroneous” autopsy of her son.

She said Sator, in his autopsy report, revealed that the nature of case was pathological and the cause of death was asphyxia due to bleeding pulmonary tuberculosis. This was contrary to the findings of Cam.

“Needless to state, the aforementioned graphical comparison would readily reveal that the cause of death of my son is well-supported by the findings of Dr. Cam in his re-autopsy report while the findings of Dr. Sator is patently and grossly incorrect,” the complaint read.

Aside from the filing of complaint, Shantylle said they will be holding a prayer rally today from Plaza Independencia to Colon St.

The assembly time at Plaza Independencia will be 9:30 a.m. She said she has no idea who will be joining the rally but she heard that there were supporters of Mario Alfie who will be joining.

“Tomorrow (today) we will commemorate the 40 days since namatay ang akong brother. Naa’y mga supporters niingon nga muadto daw sila sa mga Metro branches and will wear black,” she said. –(FREEMAN)
