Party-list kinundena ang pagkalas ng Pinas sa ICC

Itinayo ang International Criminal Court upang imbestigahan at litisin ang mga indibidwal na inire-reklamo kaugnay ng genocide, war crimes, crimes against humanity at crime of aggression.

MANILA, Philippines —  Kinundena ng mga militanteng kabataan ang administrasyon ni Pangulong Rodrigo Duterte matapos pormal na lisanin ang International Criminal Court nitong Linggo.

Itinayo ang ICC upang imbestigahan at litisin ang mga indibidwal na inire-reklamo kaugnay ng genocide, war crimes, crimes against humanity at crime of aggression.

"He must pay for all his crimes against the Filipino people," ayon sa Kabataan party-list sa isang pahayag.

"From the rampant extrajudicial killings since his regime began, to starving the people whilst emptying their pockets through his bogus economic policies, and by openly selling our country's resources to imperialist countries, Duterte must he ashamed by burning our country down."

Noong Lunes, sinabi ng Malacañang na pipigilan mula sa pagpasok sa bansa ang mga representante ng ICC kung ipagpipilitang imbestigahan ang mga diumano'y extrajudicial killings ng Pangulong Rodrigo Duterte kaugnay ng kanyang madugong gera kontra droga.

"If they say ‘we will be investigating,’ perhaps they will be denied [entry] by the [Bureau of] Immigration," ayon kay presidential spokesperson Salvador Panelo sa isang press briefing.

Dagdag ni Panelo, hindi raw inilathala sa Official Gazette ang pagpasok sa Rome Statute, ang tratadong lumikha sa ICC. Dahil dito, hindi raw masasabing naging kabahagi talaga ang Pilipinas dito.

Taong 2018 noong unang inilutang na ni Duterte ang idea ng pag-alis sa ICC.

Giit ng Kabataan, takot lang si Digong na mahatulan dahil sa kanyang mga sala.

Sa ngayon daw kasi, namamayani na ang "political persecution" at nagiging "obsolte" na ang rule of law sa bansa.

"His fear from being judged guilty for all his crimes against the Filipino people has only made him a madman who is hell-bent on keeping his powers, even planning to extend it through charter change," kanilang paliwanag.

Una nang sinabi ng ICC na ikinalulungkot nila ang pag-alis ng Pilipinas mula sa Rome Statute.

"I sincerely hope that the departure of the Philippines from the Rome Statute is only temporary and that it will re-join the Rome Statute family in the future. Encouraging universal adherence to the Rome Statute is key in strengthening our collective efforts to promote accountability for atrocity crimes and the rule of law," sabi ni O-Gon Kwon, President of the Assembly of States Parties ng ICC.

Ani Kwon, nakasalalay mula sa tuloy-tuloy na suporta ng international community ang pagiging epektibo ng ICC.

Inquiry tuloy pa rin

Samantala, iginiit naman ng Human Rights Watch na haharap pa rin sa prosekusyon si Duterte kahit na iwinithdraw na ang membership ng bansa.

"Duterte’s decision to leave the ICC came on the heels of ICC prosecutor Fatou Bensouda’s announcement in early 2018 that her office would examine the thousands of extrajudicial killings in the context of Duterte administration’s 'war on drugs' since 'at least' July 1, 2016, the day after Duterte took office," sabi ni Param-Preet Singh, associate director sa International Justice Program ng HRW.

Aniya, tanging ang mga paglabag pagkatapos umalis ng ICC ang hindi malilitis.

"Even though the Philippines is no longer a party to the court’s Rome Statute, the ICC can still try crimes committed while the Philippines was a member – from November 1, 2011 until March 16, 2019," wika ni Singh.

'Yan din ang naging posisyon ni ICC prosecutor Fatou Bensouda sa kanyang Tweet kagabi.

“Pursuant to Article 127.2 of the Statute and based on prior ICC judicial ruling in the situation in Burundi, the Court retains its jurisdiction over crimes committed during the time in which the State was party to the Statute and may exercise this jurisdiction even after the withdrawal becomes effective,” sabi ni Bensouda.

"My office's independent and impartial preliminary examination into the situation in the Philippines continues."

Kaiba ng imbestigasyon, layon ng examination na alamin kung may jurisdiction ba ang korte sa kaso ng Pilipinas.

Bagama't sinabi raw ni Duterte na kaya niyang magdala ng katarungan sa mga Pilipino, kwinestyon ng HRW kung bakit tatatlo pa lamang ang naco-convict na mga pulis sa kabila ng libu-libong namatay mula sa "war on drugs.

Umabot na sa 27,000 ang napatay sa kampanya kontra droga ng administrasyon sa estima ng United Nations.

Kahit na hindi na raw makapanghihimasok ang ICC sa mga panibagong kaso sa Pilipinas, maaari pa rin naman daw makapagsimula ng imbestigasyon ang UN Human Rights Council bilang miyembro ng konseho nito.

"As a member of the council, the Philippines is obligated to uphold the 'highest standards' of human rights, to 'fully cooperate' with the council, and accept increased scrutiny of its rights record to ensure it adheres to its membership responsibilities," dagdag ni Singh.

"A UN-led investigation could shine the spotlight on Duterte’s efforts to block accountability, and raise the pressure on him and his government to change course."
