Ang NPC kay Honrado

ISANG kalatas ang ipinalabas ng National Press Club of the Philippines Jerry S. Yap tungkol kay MIAA ge­neral manager Angel Honrado ang ilalathala ‘in toto’ ng Chief Kuwago para ang madlang people sa Philippines my Philippines, Senador,Congressmen at iba pa ang humusga. Kung tama o mali ang gagawin bigyan ng restriksyon at sikilin ang malayang pamamahayag ng mga reporter na kumokober at nagbibigay ng tamang balita sa mga corruption at sa mga nangyayari sa  Ninoy Aquino International Airport.

Restriction to airport reporters violates liberty of the press The National Press Club reminds Ninoy Aquino In­ternational Airport (NAIA) chief, Angel Honrado, that it is a violation of the fundamental right to press freedom if he will restrict accredited reporters to the NAIA lobby areas only.

Acts like this violate not only Section 4, Article 3 of the Constitution that says “no law shall be passed abridging the freedom of expression, of speech, and of the press.” 

The acts of restricting reporters to the lobby area also violate Article 32 of the Civil Code of the Philippines giving right to award for damages for persons whose rights to press freedom is violated by any person.

Mr. Honrado must know that the right to press freedom begins from the gathering of information.  If the gathering of information is prohibited, any journalist will have nothing to write that his right to express and write articles to be published is therefore effectively curtailed.

For this, the NPC hereby quotes in toto the pertinent law:

“Art. 32. Any public officer or employee, or any private individual, who directly or indirectly obstructs, defeats, violates or in any manner impedes or impairs any of the following rights and liberties of another person shall be liable to the latter for damages:

“(2)  Freedom of speech;

“(3)  Freedom to write for the press or to maintain a periodical publication;

“In any of the cases referred to in this article, whether or not the defendant’s act or omission constitutes a criminal offense, the aggrieved party has a right to commence an entirely separate and distinct civil action for damages, and for other relief. Such civil action shall proceed independently of any criminal prosecution (if the latter be instituted), and mat be proved by a preponderance of evidence.

“The indemnity shall include moral damages. Exemplary damages may also be adjudicated.

“The responsibility herein set forth is not demandable from a judge unless his act or omission constitutes a violation of the Penal Code or other penal statute.”

The NPC therefore hopes Mr. Honrado to learn from this curve.
