LEGAZPI CITY Philippines – Former Albay governor Fernando Gonzales is now the official representative of the province’s third district after the Supreme Court annulled two Comelec resolutions which proclaimed incumbent Rep. Reno Lim as winner in the May 2010 elections as well as dismissed the petition filed by Lim and Stephen Bichara for disqualification and cancellation of Gonzales’ certificate of candidacy.
In a decision, the Supreme Court dismissed the petition for disqualification and cancellation of the certificate of candidacy of Gonzales without prejudice to the filing of a proper petition before the House of Representatives Electoral Tribunal which also raised the same question on the citizenship qualification of the petitioner.
The Court also annulled and set aside the resolution of the Comelec Second Division dated May 8, 2010 and the Comelec resolution dated July 23, 2010 in SPA No. 10-074(DC) which proclaimed Lim as winner.
