No bail for man who “raped” housemaid

CEBU, Philippines - The Cebu City Prosecutor’s Office recommended no bail against a 28-year old man who allegedly raped his housemaid in January 15, 2012.

State Prosecutor Dixon Fuentes elevated the criminal case of rape before the court after accused, Joel Jame Bacayo, failed to submit his counter-affidavit to answer the allegations filed against him.

In her affidavit, the 22-year old victim who is a native of Cagayan de Oro City, stated that on the said date she was allegedly sexually abused by her employer.

The victim said that while she was lying in bed due to fever and stomach pain, the accused entered her room.

“Bacayo told me take care of his baby, who was crying,” she said.

When she was about to carry the baby, she said the accused held her right arm and ordered her to close the door but she resisted prompting the latter to close it himself.

The victim said the accused asked her if she had crush on him and she told him that “she respected him and his live-in partner.”

She said that when she left the room, the accused allegedly followed her then asked where she was going. She replied that she will throw the garbage.

The accused then instructed her to go back because the baby was crying.

After taking care of the baby, she said she went to her room and was about to sleep but the accused went inside and locked the door.

There, she said she was raped by the accused. The victim said Bacayo threatened to kill her if she will make noise.

The victim revealed that the accused has been rehabilitated for five years for drug addiction.— /MIT (FREEMAN)
