Cyber libel case batok sa dealers gibasura

CEBU, Philippines — Gibasura sa Office of the City Prosecutor sa Mandaue City ang motion for reconsideration nga gisang-at ni Land Transportation Office-7 director Victor Emmanuel Caindec may labot sa kasong cyber libel nga iyang gipasaka batok sa mga opisyales sa lima ka mga motorcycle dealers tungod kay walay probable cause.

Si Caindec mipasaka og kaso batok sa mga kadagkoan sa Desmark Corporation, Premio Corporation, DES Strong Motors, Inc., Du Ek Sam Incorporated, ug DES Marketing, Inc. tungod sa matud pa makadaut nga pamasangil batok sa ilang buhatan.

Ang kaso may kalambigitan sa matud pa pagpakauwaw nga post diha sa Facebook page sa mga gipangkiha niadtong Pebrero 15,2021 nga nag-ingong niaslom ang ilang relasyon kang Caindec sa dihang wala sila mosugot sa tag P500 nga “under the table SOP” pagproseso sa mga rehistro o dokumento sa mga motor nga mahalin sa ilang tindahan.

Niadtong Marso 15, 2022  nadawat sa mga gikiha ang  kopya sa resolusyon nga gipirmahan niadtong Pebrero 10, 2022 ni Associate City Prosecutor Julius Pilapil, nga girekomendar nga aprubahan ni Deputy City Prosecutor Sara Vanessa Lacno ug City Prosecutor Mary Francis Daquipil.

Ang director sa LTO-7 miduso og buwag nga mga kasong kalapasan sa Cybercrime Prevention Act of 2012 batok sa mga kadagkoan sa maong mga tindahan.

Apan niadtong Agusto 15, 2021, ang piskalya mibasura sa maong mga kaso base sa rekomendasyon ni Associate City Prosecutor Cherrie Mae Cabrera-Cabilte nga gidasonan sab ni City Prosecutor Daquipil tungod sa kakuwang og probable cause.

“Apart from the finding of lack of the three essential elements of libel, undersigned is also of the view, that Complainant’s representative, RD Caindec, does not have the authority to file the instant cases on behalf of the LTO VII as well,” sumala pa sa pila ka bahin sa joint resolution.

Si Caindec miduso og mosyon nga nag-ingon siya maoy gitumbok diha sa post ug naguba ang iyang reputasyon tungod niini.

Apan si Pilapil miingon nga ang akusasyon gidirekta ngadto sa mga personnel sa LTO-7 ug dili makonsiderar nga pagpakauwaw.

“Thus, there is no reason to disturb the findings of the assailed Resolution when it found ‘that although the accusations against the personnel of LTO VII are insulting, the same is not however defamatory, based on the xxx disquisitions by the Highest Tribunal [that public officials ‘should not be too onion-skinned and should be tolerant of criticism’ especially when criticism relates to his or her official functions],” sumala pa sa resolusyon.
