MANILA, Philippines — Ibinasura ng Sandiganbayan ang kaso laban kay Sen. Joseph Victor "JV” Ejercito kaugnay ng pagbili ng matataas na kalibre ng armas na nagkakahalaga ng P2.1 milyon noong alkalde pa siya ng San Juan City.

Pinanigan ng Sixth Division ng anti-graft court ang demurrer to evidence na inihain ni Ejercito at ng 14 pang akusado upang mabasura ng technical malversation case na isinampa ng Office of the Ombudsman nitong nakaraang taon.

Iginiit ng mga akusado na walang kakayanan ang mga testigo at mga documentary evidence na patunayan na ginamit ang calamity fund ng lungsod sa pagbili ng mga armas.

“In conclusion, let it be stressed that this verdict of acquittal is based on the failure of the prosecution to present proof beyond reasonable doubt that the accused indeed used the 2008 Calamity Fund of San Juan City in the procurement and payment of the subject firearms,” nakasaad sa desisyon na isinulat ni Associate Justice Rodolfo Ponferrada.

“It must be remembered that in criminal cases, the burden of proof is on the prosecution and unless it discharge that burden, the herein accused need not even offer evidence in their behalf and they would be entitled to an acquittal,” dagdag nito.

Bukod kay Ejercito, abswelto rin sina dating vice mayors Leonardo Celles at Francisco Zamora, dating mga konsehal na sina Andoni Miguel Carballo, Vincent Rainer Pacheco, Angelino Mendoza, Dante Santiago, Rolando Bernardo, Grace Pardines, Domingo Sese, Edgardo Soriano, Joseph Christopher Torralba, Ramon Nakpil, Francis Keith Peralta at Jannah Ejercito-Surla.

Una nang ibinasura ng Fifth Division ng korte ang graft case na isinampa rin sa kanila na isinampa ng Ombudsman noong 2016 dahil sa pagbili ng 20 sub-machine guns sa HK Tactical Defense System Inc.
