‘Mud-Free Highway’ ordinance gets PB committee endorsement

CEBU, Philippines - The Cebu Provincial Board’s committee on public safety, peace and order has recommended the approval of an ordinance that requires drivers, operators, owners of trucks, heavy equipment and the like to remove mud, dirt or any debris stacked in the vehicles’ tires before leaving the construction or worksites and providing penalties in case of violation.

The proposed ordinance shall be known as “Cebu Provincial Mud-free Highway Ordinance”

One of the causes of road accidents in Cebu Province is caused by the scattered mud and dirt brought by the huge trucks from construction sites, plantations and other infrastructural and agricultural estates.

The ordinance seeks to uphold the safety of the public commuters by crafting measures to encourage the drivers to maintain their vehicles in good condition, clean and secured for the travellers to be safe from danger and harm.

Hence, this ordinance makes it an offense to deposit mud, dirt or any debris in the highways that would endanger the lives of the motorists and interrupt other users of the highway.

Violators may be facing a P3000 fine for the first offense, P5000 for the second offense and P5000 with an imprisonment of not more than six months for the third and final offense.

Meanwhile, the provincial board has passed a resolution that aims to come up with comprehensive classifications of all peace and order related ordinances for easy reference and access enacted by the Sangguniang Panlalawigan of Cebu.

The objectives of this resolution are to harmonize and update various and related legislative measures and to make the related ordinances and classification accessible to the concerned individuals who wish to access or research them.

The code allows the members of Sangguniang Panlalawigan of Cebu to determine what needs to be done out from the classification of peace and order related ordinances, paving the way to initiate improvements, amendments or reinforcement for the full force implementation.

In compliance with Section 16 of the Local Government Code of 1991, the local government units are authorized to exploit the powers expressly granted, as well as power necessary, appropriate, or incidental for their efficient and effective governance, and those which are necessary to the promotion of the general welfare.

The code seeks to improve the legislative system of the Sangguniang Panlalawigan of Cebu by making it more innovative and competent in the aspect of legislation.

The purpose of the said resolution is to disseminate thorough information to the public for accessibility and awareness of peace, order and public safety.
