- Jerry Botial, Juancho Mahusay -

MANILA, Philippines - A former movie actor who accused of raping a 20-year-old student on Friday was indicted yesterday before the city prosecutor’s office in Quezon City.

Detained at the Police Station 7 in Cubao as he awaits trial was Patrick de la Rosa, 45, provincial board member, and a former councilor, native of Mindoro and residing at Room 2407 of the Globe Tower 2 on Pioneer street in Mandaluyong City.

Records showed De la Rosa was arrested by SPO2 Joel Sioson of Police Station 7 on a complaint of the victim.

Police said that prior to the incident, the victim, together with friends, were seen by witnesses having a drinking party at Unit 2206 of the Regalia Park Tower at the corner of P. Tuazon Boulevard and EDSA in Cubao Friday night.

The suspect, accompanied by an unnamed male friend, arrived and joined the group about an hour after the girls’ drinking session started.

At around 1 or 2 a.m. Saturday, the victim allegedly felt she had enough and fell asleep in the bedroom.

Some four hours later, the victim told police she was roused from sleep as she felt something heavy pinning her on the bed. When she opened her eyes, she said she saw herself naked with De la Rosa on top of her and inside her.

She said she pushed him back and slapped him several times even as she shouted for help. Her cries allegedly drew the attention of her friends. The two rushed to the room and allegedly saw the victim naked while the suspect was dressed.

De la Rosa, through his lawyer has denied the allegations.

The case was referred by the police to Assistant City Prosecutor Nilda Ordoño who recommended no bail for the suspect’s temporary liberty.
