Zubiri denies hand in delay of electoral protest

MANILA, Philippines - Sen. Juan Miguel Zubiri denied yesterday the claims of lawyer Aquilino Pimentel III that he is delaying the process at the Senate Electoral Tribunal (SET) on their electoral protest case.

Zubiri said in a statement that his intention was simply to get to the bottom of the supposed electoral fraud that took place during the 2007 elections.

Pimentel has accused Zubiri and several members of the SET of conniving to prevent the process from moving forward while there is still time left for him to take his place in the Senate.

His allegations were based on the resolution issued by the SET last June 4, favoring Zubiri’s petition to open all of the ballots in the areas where the supposed fraud took place.

The SET took three years to examine 25 percent of the ballots that were used as samples to establish the claim of fraud in some areas.

Supreme Court senior Associate Justice Antonio Carpio, who serves as SET chairman, has indicated that the process of counting the rest of the ballots as demanded by Zubiri would probably take six years to finish or well past the end of his term.

“I am not delaying this protest. What I want to know is the truth,” said Zubiri in response to Pimentel’s allegations.

Zubiri noted that the SET has uncovered “syndicates that operated in the cities and areas perceived to be opposition bailiwicks to enhance the candidacies of certain opposition members.”

“Why are you afraid to seek the truth behind these syndicates?” he said.

Zubiri has asked the SET to open the remaining ballot boxes in Metro Manila to determine if there was really electoral fraud that took place.

“However, if the SET does not find any more evidence of election fraud in Metro Manila, then I will resign my post as senator,” he said.

Zubiri said he was confident that evidence of fraud would be found in those ballot boxes based on the determination by the SET that more than 50 percent of the ballots specially cited in the revision reports were indeed spurious.

“Accordingly, the presence of said bogus ballots must be considered as strong indicator that the elections in said areas was marred by irregularities,” the resolution stated. (with Perseus Echeminada, Sheila Crisostomo)
