Man sentenced to 12 years in jail for frustrated murder

The court yesterday sentenced a man to 12 years imprisonment for frustrated murder. Regional Trial Court judge Eric Menchavez ruled that barangay Sawang Calero resident Demetrio Cuyno is guilty of frustrated murder when he shot his neighbor Romeo Quilo last December 28, 2000.

Cuyno opted not to refute the evidence presented by the prosecution prompting the court to decide on the case based only on the prosecution's evidence.

It was learned that prior to the incident, Cuyno and Quilo had a fistfight where the latter got injured.

Quilo testified that while he was walking home at around 11:45 p.m. from a comical skit presentation in their barangay, Cuyno waylaid him and then shot him using a handgun.

The victim presented before the court the doctor who treated his gunshot wound when he was brought to a private hospital after the incident.

A neighbor named Edwin Cabarrubias, who was with Quilo when he was attacked, also testified before the court that it was Cuyno who shot his friend.

"The prosecution has presented the required quantum of proof to establish that the accused is indeed guilty as charged," judge Menchavez ruled. - Rene U. Borromeo
