“The Secretary said we will definitely file cases. Let’s just find out the facts first to determine the cases that will be filed,” matud pa sa tigpamaba sa DILG, Undersecretary Jonathan Malaya, sa mga tigbalita didro sa Manila sa usa ka press conference kagahapon.
Si Malaya miingon nga nagpaabot sila karon sa investigation report gikan sa lokal nga DILG dinhi sa Central Visayas aron matan-aw kun unsa nga mga kaso ang mapasaka batok sa kanhi mayor.
Si Osmeña nanalipod sa iyang aksyon sa opisina nga karon dili na mapuslan pa sa nakapildi kaniyang si Mayor Edgardo Labella.
Matud ni Osmeña nigasto siya og P2 milyones ug nagkontribusyon iyang mga higala aron lang mapanindot ang maong opisina kay ang konseho wa mohatag og pundo aron kini mapaayo niadtong 2016.
Apan alang kang Malaya, dili madawat ang eksplinasyon ni Osmeña kay nasayod man unta kini nga ang “immovable objects” dili mahimong tangtangon gikan sa mga buhatan sa gobiyerno.
“He knows the Civil Code. He is aware that you can’t remove immovable objects,” matud ni Malaya kinsa nakaingon nga tungod sa gibuhat ni Osmeña naapektahan ang serbisyo sa City Hall kay adto na sa laing opisina nagtrabaho karon si Labella.
“Obviously, something wrong happened and we don’t want to keep the people guessing why it is taking a long time for the DILG to take action,” matud ni Malaya.
Daan ng gipahibalo sa Cebu City’s Legal Office nga pasakaan nila og kaso si Osmeña nga pagpangawat ug kalapasan sa Anti-graft and Corrupt Practices Act.
Apil sa pasakaan og kaso ang iyang executive assistant, Raymund Paul Climaco Taboada, ug ang 27 mga trabahante sa Dakay Construction nga maoy gisugo pagkuha sa mga personal nga gamit sa mayor gikan sa maong opisina.
Si City Attorney Rey Gealon mingon nga duna gyuy“evident bad faith” sa pamaagi sa paghawan sa opisina.
“The wanton destruction of the Office of the Mayor, stripped to the bone without even the barest essentials, is demonstrative of moral obliquity or conscious wrongdoing for some perverse motive or ill will,” matud ni Gealon.
Ubos sa Anti-Graft and Corrupt Practices Act, ang mga opisyales sa gobiyerno manubag gyud kun makamugna og “undue injury” ngadto sa gobiyerno.
“In this case, they conspired, confederated and cooperated with each other in damaging government property by forcibly removing the immovable properties found in the Office of the Mayor which belong to the Cebu City Government, without any valid and lawful authority, with intent to gain, without the use of violence against or intimidation of persons or force upon things,” dugang pa ni Gealon.
