                    [Summary] =>

The prosecution's first witness in the shooting to death of former Biliran governor Danilo Parilla at the port area last September 7 positively identified Eugenio Corpin as the gunman during yesterday's hearing.

Marilyn Tagal yesterday testified in court that she was only about a meter-away behind Parilla when a man - whom she later identified as Corpin - shot Parilla in the head causing the latter to fall in front of her.

Tagal, Corpin and Parilla were aboard a ship from Naval town in Leyte, on its way to Cebu.

Adelino Sitoy, head of the panel of private prosecutors, successfully convinced the court to allow them to file amended information that would state that Corpin is a "recidivist," meaning a person who always commits crimes and was already convicted of violating the law.

"A recidivist is one who, at the time of his trial for one crime, shall have been previously convicted by final judgment of another crime" of the same nature, said a recent Supreme Court ruling.

The scheduled arraignment of Corpin yesterday was delayed due to the motion of private prosecutor Adelino Sitoy for an amended information.
