Solar wins P659-M suit versus Sky Cable
MANILA, Philippines - Solar Entertainment has won its P659-million suit against Lopez-owned Sky Cable for the unauthorized broadcast of exclusive National Basketball Association programs.
This after the Mandaluyong Regional Trial Court (RTC) granted the petition of Solar Entertainment chair Wilson Tieng for issuance of a writ of preliminary attachment on bank properties of Lopez-owned Sky Cable and its affiliate ABS-CBN Corp.
The Muntinlupa RTC branch 209 issued the writ to secure the payment of unpaid carriage fees due to Solar Entertainment totaling P659 million.
In the ruling received by parties earlier this week, Judge Monique Quisumbing-Ignacio found merit in Tieng’s complaint, noting that “all the relevant facts and circumstances point to the presence of fraud.”
The court also sided with Tieng’s allegations of ABS-CBN’s maneuvers to ultimately gain control of the distribution of NBA games in the Philippines.
“Sky Cable and ABS-CBN intentionally withheld payment of subscription and/or channel fees…in order to render Solar financially incapable of paying its license fees to NBAE. Solar’s breach would result in destroying its relationship with NBAE thereby leaving…ABS-CBN as the only licensee in good standing with NBAE,” read the ruling.
