MANILA, Philippines — Pinawalang bisa ng Court of Tax Appeals (CTA) ang tax deficiency assessment ng mag-asawang dating senador at boxing legend Manny Pacquiao at Jinkee na may halagang P2.2 bilyon.

Ayon sa CTA Special Third Division, ang assessment laban sa mag-asawang Pacquiao ay “void” hinggil sa paglabag sa kanilang karapatan sa due process at kakulangan ng “factual basis”.

Hinahabol ng pamahalaan ang P2.22 bilyong buwis ng mag-asawa kasama na ang interests at surcharges para sa panalo ni Manny sa kanyang laban sa boxing abroad at product endorsements noong 2008 at 2009.

Sa ruling ng korte, hindi nakita na nagkaroon ng due process sa kasong ito, walang notice of informal conference (NIC) na naipadala ang BIR sa mga Pacquiao, na requirement alinsunod sa batas upang mabigyang pagkakataon na makapagpaliwanag ang inaakusahan sa kaso.

“(R)ecords reveal that the NIC was not served to petitioners (Pacquiaos). No proof of service was presented to show that it was actually received by petitioners,” nakasaad sa CTA.

Ayon sa CTA, ang assessment sa kaso laban sa mag-asawang Pacquiao ay pawang naibase lamang sa news articles.

“It should be consi­dered void if not supported by sufficient evidence or is based on mere presumptions. Likewise, there is no showing that the revenue officers performed due diligence to confirm the veracity of the information contained in the said articles before issuing the subject (tax) assessment,” ayon sa CTA.
