Mandatory drug test sa local bets puwede – Palasyo

MANILA, Philippines — Nilinaw ng Malacañang na hindi nila ibinabasura ang panukala ng Philippine Drug Enforcement Agency (PDEA) na mandatory drug test sa mga kakandidato sa 2019 midterm elections.

Sinabi ni Presidential Spokesperson at Chief Presidential Legal Counsel (CPLC) Salvador Pa­nelo, katunayan ay kinikilala nila ang intensyon ng PDEA para mabigyan ng impormasyon ang mga botante kaugnay sa mga pipiliing kandidato sa eleksyon.

Ayon kay Panelo, may problema lamang sa pagsasagawa ng nasabing mandatory drug test sa mga kandidato sa pagka-senador o pagka-kongresista dahil labag ito sa Saligang Batas, sang-ayon sa ruling ng Korte Suprema sa kaso ng Social Justice Society v. Dangerous Drugs Board.

Nakapaloob umano sa nasabing ruling na hindi pinapayagan ang mandatory drug testing sa mga senador dahil karagdagang kuwalipikasyon ito na wala sa probisyon ng Konstitusyon.

“The Palace wishes to clarify that it does not dismiss in toto PDEA’s proposal to conduct mandatory drug testing of political aspirants for next year’s elections. What we see, however, as problematic is the proposed conduct of such tests for those seeking a seat in Congress, whether in the Senate or in the House of Representatives, in the upcoming elections. This is because the Supreme Court has already pronounced, in the case of Social Justice Society v. Dangerous Drugs Board, that mandatory drug testing for senators is not allowed as it imposes additional qualifications beyond the provision of the Constitution. In other words, even a law directing such mandatory drug tests will be struck down as unconstitutional,” ani Panelo.

Pero lumalabas umano na maaaring isailalim sa mandatory drug testing ang mga kandidato sa local government units (LGUs) gaya ng gobernador, mayor, mga konsehal at bokal dahil hindi nakasaad sa Konstitusyon ang kanilang kuwalipikasyon sa pagtakbo.
