Kill-switch to erase data in mobile phones sought

MANILA, Philippines — A lawmaker has sought to requireto all cellphone network service providers to pre-install "kill-switch" software in their units to enhance the security and privacy of their postpaid subscribers.

AMA partylist Rep. Lorna Velasco said the software allows network service providers to remotely and permanently disable and erase all data and private information in cellphones reported to be stolen, rendering the device useless for future use.

Velasco filed House Bill 4511, to be known as Kill-switch Phone Security Act of 2014, to address the growing incidence of breaches in security and privacy as a result of cellphone theft.

"The large number of cellphones ... gives rise to high incidents of crime involving theft and robbery thereof. These criminal acts not only endanger the physical safety of victims but also compromise the security of the personal and private information stored in the stolen devices’ memories," Velasco said.

Velasco sought the immediate passage of the measure saying its enactment will effectively weaken, if not eliminate completely, the black market for stolen cellphones and subsequently reduce crimes related to mobile cellphones.

"In this present age of constant change and intensive use of ever-evolving technology, it is incumbent upon us to enact laws that respond timely and appropriately to new safety and security challenges," Velasco said.

Under the bill, all cellphone network service providers shall equip all mobile phones they provide to postpaid users with the software.
The network service provider, however, shall remotely disable and erase all data and mobile cellphone only upon the request of the registered subscriber and after proper verification.

"The kill-switch software shall in no case be utilized for other purposes other than the prevention of the unauthorized use of a third party," the bill provides.

The bill mandates the National Telecommunications Commission (NTC), the Department of Transportation and Communications (DOTC) and other concerned agencies to enforce the proposed Act and formulate the necessary implementing rules and regulations.
