2 nabbed for posting sex video with minor

CEBU, Philippines —  Two men were arrested by police for allegedly posting a sex video involving a 13-year-old girl on social media last Thursday night in Lapu-Lapu City.

Gender and Development officer Anita Jumamil of Barangay Basak said that personnel from Mactan Police Station 2 arrested McClark Alvaro Aying, 21, who works as an assistant chef of a Chinese restaurant, and his companion Jomel Ceniza Pagalan, 23, around 10 p.m. near a convenience store in Barangay Maribago.

Prior to their arrest, Jumamil said the minor’s mother sought help from the Basak Barangay Hall last Monday after finding out that her daughter was involved in a sex video with an adult and that it had been uploaded on Facebook.

“Atong Lunes ang inahan niadto sa among opisina unya karon nagpatabang namo ba nga mao pa niya sa pagkita sa facebook sa iyang anak, na-open man niya, wala siya kahibalo nga mao diay ‘tong nahitabo ba, among gi-blotter,” Jumamil said.

Jumamil contacted the City Social Welfare and Development Office for advice but failed to contact them as personnel of the said office reportedly had a seminar.

Jumamil took the initiative and coordinated with the police to arrest Aying who is accused of uploading the video.

The arrest was scheduled Monday, but it was only on Tuesday night when Aying responded to the online chat of the victim and her mother and agreed to meet. The suspect reportedly offered to delete the sex video in exchange for something.

“Padalhon man kuno ni siyag usa ka minor,” Jumamil said.

Both parties agreed to meet near the Marigondon Police Station but the venue for the meet-up was later moved to a convenience store in Barangay Maribago.

From there, Jumamil said the minor went to the meeting place and met with Aying. Pagalan, Aying’s companion, also showed up by the time the minor arrived.

Jumamil said that right then and there they were immediately arrested by police personnel from Mactan Police Station 2.

“Naposasan sila duha,”Jumamil said.

Aying reportedly denied the allegations that he uploaded the sex video and that he and the minor both agreed to have sex. He also claimed a lot of people would use his cellphone and any of them could have uploaded the video.

“Wala man nako gi-upload. Duna nahitabo kay naa mi kasabutan ato. Kahibawo kong minor siya. Wala ko kahuna-huna ana, siya man nihatag og kasayuran nga mobuhat og ingon ana. Taparan na ka di pa ba kaha nimo kan-on?” Aying said, adding that he regretted his decision.

Pagalan also denied uploading the sex video. He claimed he was not aware of the situation.

Meanwhile, the minor’s mother said that she is willing to file a case against the suspects who earlier met with her daughter through Facebook.

“Mao ako ni sila file-an aron matagam kay against g’yud ni sa law. Inosente g’yud ni akong anak kay wala g’yud siyay kalibutan, mokatawa ra,” she said, adding that her daughter must have given in to peer pressure to commit the act.

Both suspects are now detained in the Mactan Police Station.

Police Officer 2 Geralden Pacelan of the station's Women and Children Protection Desk said charges for violating Republic Act 9995 or the Anti-Voyeurism Act of 2009 filed against the suspects.

“Mabalhog g’yud sila sa prisohan. Sa investigation namo, naa g’yuy salaod sila nga nahimo, mao to amo gidakop. Dili g’yud maayo na mahilambigit og sex video sa minor, di sad g’yud maayo mag-video ug maong himoong blackmail sa uban para mahadlok na nabiktima,” Pacelan said. — BRP (FREEMAN)
