Pinas lang ang may karapatan sa Benham Rise – Carpio

MANILA, Philippines — Ipinaliwanag ni Supreme Court Senior Associate Justice Antonio Carpio na tanging ang Pilipinas lamang ang may karapatan sa Benham Rise kasunod ng pagpunta doon ng mga barko ng China.

Tinukoy ni Carpio ang Article 60 ng 1982 United Nations Convention on the Law of the Sea (UNCLOS) kung saan nakasaad na ang coastal state lamang ang maaaring magtayo ng mga gusali sa kanilang exclusive economic zone (EEZ) or continental shelf.

"No other state can put up a structure within our EEZ and within the extended continental shelf," wika ni Carpio ngayong Huwebes.

"In the EEZ, we have exclusive rights to all the natural resources—the fish and the oil, gas and minerals but in the extended (continental shelf), we only have exclusive right to the oil, gas and minerals, not the fish," dagdag niya.

May lawak na 150 nautical miles ang extended continental shelf bukod pa sa 200-nautical-mile limit.

"The coastal State shall have exclusive jurisdiction over such artificial islands, installations and structures, including jurisdiction with regard to customs, fiscal, health, safety and immigration laws and regulations," nakasaad sa paragraph 2, Article 60 ng UNCLOS.

Nito lamang ay ikinaalarma ng Department of National Defense ang pagpunta ng Chinese ships sa Benham Rise ngunit kalaunan ay sinabi ni Pangulong Rodrigo Duterte na pinayagan niya ang mga ito.

Sinabi ni Carpio na maaari naman mag-survey ang China kung ang pag-aaralan lamang ay ang mga isda habang ang iba ay bawal.

"But if it's a research on oil, gas and minerals, they cannot do that," ani ng hukom.

Wala naman masagot si Carpio nang tanungin kung may maaaring managot sa pagpasok ng China sa Benham Rise. Aniya hindi niya alam kung ano ang napagkasunduan ng dalawang bansa.

"We still don't know what their agreement was about so it's premature now to discuss the consequences because we don't know what kind of agreement entered into.”
